Booking Terms

1. Introduction

These Booking Terms and Conditions (“Terms”) apply to all bookings made with Best4Travel and Best4Cruises, trading names of Wecanbookit Irl Ltd (“Best4Travel”, “we”, “our”, “us”). Best4Travel acts both as a Package Organiser and as a Retail Agent, depending on the travel arrangements booked. Your Booking Confirmation will identify the capacity in which we are acting for your booking

Please read these Terms carefully before making a booking. They explain your rights and responsibilities and form part of the legally binding contract between you and us.

By making a booking with Best4Travel or Best4Cruises you confirm that:

  • you have read and accepted these Terms;
  • you are at least 18 years of age;
  • you have the legal authority to make the booking;
  • you are authorised to accept these Terms on behalf of everyone included in the booking;
  • all information you provide is accurate and complete.

These Terms should be read together with:

  • your Booking Confirmation;
  • your Invoice;
  • your Itinerary;
  • any Supplier Terms and Conditions applicable to your booking;
  • our Privacy Notice;
  • our Website Terms of Use.

Where there is any conflict between these documents, the Supplier’s mandatory conditions and applicable law will take precedence where required.

2. Definitions

For the purposes of these Terms:

Lead Passenger means the person making the booking.

Party means every traveller included within the booking.

Supplier means any airline, cruise line, hotel, tour operator, transfer company, rail operator, ferry operator, insurance provider, attraction, destination management company or other third party supplying part of your travel arrangements.

Package Holiday has the meaning given under the European Union (Package Travel and Linked Travel Arrangements) Regulations 2018.

Travel Arrangements means all travel services booked through us including but not limited to flights, cruises, hotels, villas, apartments, transfers, excursions, tours, insurance and ancillary travel services.

Working Day means Monday to Friday excluding Irish public holidays.

3. Who We Are

Best4Travel and Best4Cruises are trading names of Wecanbookit Irl Ltd, a company incorporated in Ireland.

We are licensed by the Irish Aviation Authority as a Travel Agent and Tour Operator where applicable.

4. Your Booking Contract

A booking does not become legally binding when:

  • you request a quotation;
  • you submit an online enquiry;
  • you place a holiday into an online basket;
  • you make a provisional reservation;
  • you pay a holding deposit where supplier confirmation is still outstanding.

A legally binding contract is only formed when ALL of the following have occurred:

  1. we have accepted your booking;
  2. the Supplier has confirmed availability;
  3. any required payment has been received;
  4. we have issued your Booking Confirmation.

Until that point we reserve the right to refuse any booking for any lawful reason.

This includes but is not limited to:

  • pricing errors;
  • supplier withdrawal;
  • supplier refusal;
  • fraud prevention;
  • payment failure;
  • inability to verify passenger information.

5. Booking on behalf of Others

If you make a booking for more than one traveller you confirm that:

  • you have authority to act on behalf of every traveller;
  • every traveller has authorised you to enter into this contract;
  • you have provided these Terms to every traveller;
  • every traveller agrees to be bound by these Terms.

The Lead Passenger accepts responsibility for:

  • all payments;
  • communicating booking information;
  • notifying us of changes;
  • ensuring all travellers comply with these Terms.

6. Accuracy of Information

It is your responsibility to ensure that all passenger information supplied to us is correct.

This includes:

  • names exactly as shown on passports;
  • dates of birth;
  • passport details;
  • nationality;
  • contact details;
  • email address;
  • telephone number.

Failure to provide accurate information may result in:

  • airline penalties;
  • supplier amendment fees;
  • cancellation of tickets;
  • refusal to travel;
  • immigration refusal;
  • additional costs.

Best4Travel accepts no responsibility for losses arising from incorrect information supplied by you.

7. Quotations and Availability

All quotations are:

  • subject to availability;
  • subject to confirmation;
  • subject to supplier availability;
  • subject to currency fluctuations where applicable;
  • subject to taxes and government charges;
  • subject to correction of genuine pricing errors.

No quotation constitutes an offer capable of acceptance until confirmed by us.

8. Pricing Errors

Despite our best efforts, occasionally pricing or availability errors may occur.

Examples include:

  • incorrect airfare loading;
  • hotel pricing errors;
  • supplier system errors;
  • currency conversion errors;
  • website technical faults;
  • human error.

Where an obvious pricing error has occurred, Best4Travel reserves the right to cancel the booking before travel and refund all monies paid.

A booking made using an obvious pricing error does not create a binding contract.

9. Deposits

Most holidays require a deposit at the time of booking.

The amount of the deposit depends upon:

  • destination;
  • airline;
  • cruise line;
  • tour operator;
  • supplier requirements;
  • time before departure.

Some bookings require full payment immediately.

Examples include:

  • low-cost airlines;
  • instant purchase airfares;
  • promotional fares;
  • cruise promotions;
  • non-refundable accommodation.

Deposits are generally non-refundable unless otherwise stated.

10. Balance Payments

The balance must be paid by the due date stated on your confirmation invoice.

It is your responsibility to ensure payment reaches us before the due date.

Failure to receive a reminder from us does not remove your responsibility to pay on time.

11. Failure to Pay

If payment is not received by the due date we reserve the right to:

  • cancel your booking;
  • retain any deposit paid;
  • recover supplier cancellation charges;
  • recover administration costs;
  • recover legal costs where applicable.

Any outstanding balance remains payable if supplier cancellation charges exceed monies already paid.

12. Payment Methods

We accept payment by methods notified on our website or in our branches.

We reserve the right to decline certain payment methods for fraud prevention or operational reasons.

Payments made by debit card, credit card or bank transfer may be subject to security verification.

We reserve the right to request additional identification before accepting payment.

13. Fraud Prevention

To protect our customers and suppliers we reserve the right to refuse, suspend or cancel any booking where we reasonably suspect:

  • fraudulent activity;
  • stolen payment cards;
  • identity theft;
  • money laundering;
  • abuse of promotional offers;
  • speculative bookings;
  • false passenger information.

Where fraud is suspected we may:

  • contact your bank;
  • request proof of identity;
  • delay ticketing;
  • cancel the booking;
  • report the matter to An Garda Síochána or other relevant authorities where appropriate.

14. Chargebacks and Payment Disputes

If you believe a payment has been taken incorrectly, please contact us immediately so we can investigate.

If you initiate a chargeback or payment dispute without first giving us a reasonable opportunity to resolve the matter, we reserve the right to:

  • suspend future bookings;
  • recover supplier losses;
  • recover chargeback fees;
  • recover legal costs where permitted by law.

Nothing in this clause limits your statutory rights to dispute unauthorised or fraudulent card transactions.

15. Changes Requested by You

If, after your booking has been confirmed, you wish to change any part of your travel arrangements, we will do our best to assist. However, we cannot guarantee that changes will be possible.

All changes are subject to:

availability;

  • Supplier acceptance;
  • payment of any additional costs;
  • payment of any Supplier amendment fees;
  • payment of Best4Travel administration fees.

Changes may result in your original booking becoming non-refundable.

Certain Suppliers do not permit any amendments once a booking has been confirmed.

16. Administration Fees

Best4Travel may charge a reasonable administration fee, in addition to any Supplier charges for processing changes requested by you.

Typical administration charges may include:

*These fees are in addition to any charges imposed by airlines, cruise lines, hotels, tour operators or other Suppliers.

Administration fees may vary depending on the complexity of the amendment.

17. Name Changes

Passenger names must exactly match the relevant travel documentation.

Many airlines and cruise lines do not permit name changes after ticket issue.

Where a Supplier permits a name change:

  • all Supplier fees;
  • any fare increases;
  • any taxes;
  • Best4Travel administration charges

must be paid before the amendment can be processed.

Where a Supplier treats a name change as a cancellation and rebooking, the applicable cancellation charges will apply.

Minor spelling corrections may still incur airline or Supplier charges.

18. Changes to Travel Dates or Destination

Requests to change:

  • departure date;
  • destination;
  • cruise sailing;
  • airline;
  • hotel;
  • tour;
  • itinerary;

are treated by many Suppliers as a cancellation of the original booking and the creation of a new booking.

Where this occurs:

  • cancellation charges may apply;
  • current pricing will apply to the new booking;
  • promotional prices previously available may no longer be offered.

19. Transfer of a Booking

Where permitted by law and by the relevant Supplier, you may transfer your booking to another person.

Transfers:

  • must be requested in writing;
  • must be received within the period permitted by the Supplier;
  • cannot be guaranteed;
  • are subject to Supplier approval.

The replacement traveller must:

  • satisfy all booking conditions;
  • accept these Terms;
  • meet all visa, passport and health requirements.

Both the original traveller and the replacement traveller shall be jointly and severally liable for:

  • any outstanding balance;
  • amendment fees;
  • Supplier charges;
  • additional costs arising from the transfer.

20. Cancellation by You

You may cancel your booking at any time by notifying us in writing.

Cancellation takes effect on the Working Day we receive your written notification.

Telephone cancellation requests should always be confirmed by email.

Where a booking includes multiple travellers, cancellation by one traveller may affect:

  • room occupancy;
  • cabin occupancy;
  • promotional pricing;
  • single room supplements;
  • group discounts.

Any additional costs resulting from one traveller cancelling shall be payable by the remaining travellers.

21. Cancellation Charges

Many travel arrangements are purchased on non-refundable or partially refundable terms.

Cancellation charges will depend on:

  • the Supplier’s conditions;
  • the date of cancellation;
  • the type of booking;
  • airline conditions;
  • cruise line conditions;
  • accommodation conditions.

Unless otherwise advised at the time of booking, cancellation charges may be up to 100% of the total holiday cost, regardless of when cancellation occurs.

Certain travel arrangements, including but not limited to:

  • scheduled airline tickets;
  • low-cost airline tickets;
  • cruise deposits;
  • promotional fares;
  • instant purchase airfares;
  • special event tickets;
  • theatre tickets;
  • sporting events;
  • attraction tickets;
  • visas;
  • insurance premiums;
  • service fees;

may be non-refundable immediately after booking.

Where multiple Suppliers are included within one booking, different cancellation charges may apply to different parts of your holiday.

22. No Shows

If you:

  • fail to check in;
  • miss your flight;
  • miss your cruise embarkation;
  • arrive after departure;
  • voluntarily decide not to travel;

this will be treated as a cancellation by you.

No refund will normally be payable.

Unused travel arrangements cannot normally be refunded once travel has commenced.

23. Partial Cancellation

If one or more members of a booking cancel:

  • the remaining travellers may have to pay higher prices;
  • room occupancy supplements may apply;
  • cruise cabin occupancy supplements may apply;
  • promotional discounts may be lost.

Any increase in price must be paid before travel.

24. Refunds

Where a refund is due:

  • it will normally be processed using the original payment method;
  • it will only be made after funds have been received from the relevant Supplier where applicable;
  • administration fees are non-refundable;
  • insurance premiums are non-refundable once cover has commenced;
  • visa fees are non-refundable;
  • amendment fees are non-refundable.

Refund processing times depend on the Supplier and payment provider.

Best4Travel cannot be held responsible for delays caused by third parties.

25. Credit Notes

Where offered by a Supplier, a refund may instead be provided as:

  • a travel credit;
  • future travel voucher;
  • airline credit;
  • cruise future cruise credit.

Acceptance of a credit or voucher may be subject to separate terms and conditions.

Once accepted, any refund rights may be replaced by the conditions attaching to that credit.

26. Supplier Cancellation Terms

Many Suppliers operate under their own booking conditions.

By making a booking you acknowledge that:

  • airlines;
  • cruise lines;
  • hotels;
  • tour operators;
  • transport providers;
  • insurance providers;

may each have separate cancellation and amendment policies.

Where a Supplier’s cancellation policy is stricter than these Terms, the Supplier’s policy shall apply.

Copies are available on request.

27. Travel Insurance and Cancellation

We strongly recommend comprehensive travel insurance at the time of booking.

Travel insurance may cover cancellation costs arising from certain unforeseen events, subject to the terms and conditions of your policy.

It is your responsibility to ensure your insurance policy provides adequate cover for:

  • cancellation;
  • medical expenses;
  • baggage;
  • travel disruption;
  • supplier failure where applicable;
  • personal liability;
  • cruise cover where relevant.

Failure to obtain adequate insurance is entirely at your own risk.

28. If You Wish to Abandon Your Holiday

If you choose to end your holiday early for personal reasons, no refund will normally be payable for:

  • unused accommodation;
  • unused flights;
  • unused cruises;
  • unused excursions;
  • unused transfers;
  • unused meals;
  • unused travel services.

Any additional costs incurred in returning home early will be your responsibility unless otherwise covered by your travel insurance.

29. Changes Made by Best4Travel Before Departure

Travel arrangements are planned many months in advance and, occasionally, changes may become necessary before departure.

Best4Travel reserves the right to make changes to any aspect of your booking before travel where reasonably necessary.

Most changes are minor and will not significantly affect your holiday.

Examples of minor changes include, but are not limited to:

  • changes to flight numbers;
  • changes to flight times;
  • changes of aircraft type;
  • changes to departure terminals;
  • changes to transfer providers;
  • changes to meal arrangements;
  • changes to excursion timings;
  • changes to entertainment programmes;
  • changes to hotel facilities;
  • changes to cabin or room numbers;
  • changes to check-in procedures.

Minor changes do not entitle you to cancel your booking or claim compensation.

Where reasonably practicable, we will notify you of any known changes before departure.

30. Significant Changes Before Departure

Occasionally, a significant change may become necessary.

Examples may include:

  • a substantial change to your destination;
  • a significant reduction in the duration of your holiday;
  • a change to accommodation to one of a materially lower standard;
  • cancellation of your holiday before departure;
  • any other change which significantly alters the main characteristics of your Package Holiday.

Where a significant change is required, and where required by applicable law, we will notify you as soon as reasonably possible and, where appropriate, offer you one or more of the following options:

  • accept the revised arrangements;
  • accept a suitable alternative holiday (where available);
  • receive a refund in accordance with the applicable Package Travel Regulations.

Compensation will only be payable where required by law and will not apply where the change results from Unavoidable and Extraordinary Circumstances or other circumstances permitted under applicable legislation.

31. Cancellation by Best4Travel

We reserve the right to cancel your booking before departure where reasonably necessary.

This may occur where, for example:

  • the minimum number of participants required for a tour or group departure has not been reached;
  • a Supplier withdraws or cancels the travel arrangements;
  • your booking cannot reasonably be fulfilled;
  • fraudulent activity is suspected;
  • payment has not been received;
  • information required to complete the booking has not been provided;
  • circumstances arise beyond our reasonable control.

Where cancellation occurs, your rights will depend on the reason for cancellation and the applicable law.

32. Unavoidable & Extraordinary Circumstances

Neither Best4Travel nor any Supplier shall be liable to pay compensation where the performance of the contract is affected by Unavoidable and Extraordinary Circumstances which could not have been avoided even if all reasonable measures had been taken.

Such circumstances may include, but are not limited to:

  • war or threat of war;
  • terrorism or security incidents;
  • civil unrest;
  • riots or political instability;
  • acts of government;
  • border closures;
  • travel restrictions;
  • sanctions;
  • epidemic or pandemic;
  • public health emergencies;
  • quarantine requirements;
  • industrial disputes;
  • strikes by third parties;
  • air traffic control restrictions;
  • airport closures;
  • port closures;
  • adverse weather;
  • hurricanes;
  • storms;
  • flooding;
  • earthquakes;
  • tsunamis;
  • volcanic eruptions;
  • volcanic ash;
  • wildfires;
  • extreme heat;
  • extreme cold;
  • natural disasters;
  • cyber-attacks affecting transport systems;
  • failures of national infrastructure;
  • fuel shortages;
  • mandatory evacuation orders;
  • decisions of harbour masters, airport authorities or government agencies.

These events are outside the reasonable control of Best4Travel and may affect travel arrangements at short notice.

Where possible we will work with Suppliers to minimise disruption and assist customers, but additional costs arising from such circumstances may remain the responsibility of the traveller unless otherwise required by law or covered by travel insurance.

33. Supplier Changes

Travel Suppliers retain control over the services they provide.

Accordingly, Suppliers may make changes including, but not limited to:

  • changing hotels;
  • changing ships;
  • changing aircraft;
  • changing airlines;
  • changing departure airports;
  • changing transfer providers;
  • changing ports of call;
  • changing excursion schedules;
  • changing room or cabin allocations;
  • altering meal plans;
  • modifying onboard facilities.

Where such changes are made by the Supplier, Best4Travel will notify you as soon as reasonably practicable after becoming aware of the change.

34. Airline Schedule Changes

Airlines frequently amend:

  • flight times;
  • aircraft types;
  • operating carriers;
  • flight numbers;
  • departure airports;
  • arrival airports;
  • intermediate stops.

These changes are outside our control.

Flight times shown:

  • in brochures;
  • on websites;
  • within quotations;
  • on booking confirmations;

are provisional until final documentation is issued.

Even after tickets have been issued, airlines may alter schedules.

Such changes do not necessarily constitute a significant change under the Package Travel Regulations.

Passengers should avoid making irreversible arrangements, including accommodation, parking or events, until closer to departure.

35. Flight Delays

Flight delays are the responsibility of the operating airline.

Where a delay occurs, the airline is responsible for providing assistance in accordance with applicable passenger rights legislation.

Best4Travel will make reasonable efforts to assist customers where possible but cannot accept responsibility for:

  • airline operational decisions;
  • airport operations;
  • security delays;
  • immigration delays;
  • weather delays;
  • air traffic control restrictions.

Compensation for flight delays, where applicable, is governed by UK/EU passenger rights legislation and must generally be pursued against the operating airline.

36. Cruise Itinerary Changes

Cruise itineraries are subject to change at any time.

The Master of the vessel has absolute discretion to alter the itinerary where necessary for:

  • passenger safety;
  • weather conditions;
  • sea conditions;
  • mechanical reasons;
  • medical emergencies;
  • operational requirements;
  • port congestion;
  • government instructions;
  • security concerns.

Changes may include:

  • altering sailing times;
  • changing ports of call;
  • cancelling ports;
  • substituting ports;
  • overnighting in alternative ports;
  • reversing the itinerary;
  • missing ports entirely.

Such changes are considered an inherent part of cruising and do not automatically give rise to compensation or cancellation rights.

37. Hotel Changes

Occasionally it may become necessary for accommodation to be substituted.

Where this occurs we will endeavour to provide accommodation of a comparable or higher standard.

Hotel ratings vary significantly between countries and should be regarded as a general guide only.

Facilities advertised by hotels may change during the season.

Some facilities may be unavailable due to:

  • maintenance;
  • weather;
  • local regulations;
  • seasonal operation;
  • occupancy levels;
  • health and safety requirements.

Best4Travel accepts no liability where facilities are unavailable for reasons beyond our reasonable control.

38. Excursions and Optional Activities

Excursions or activities purchased directly with local providers during your holiday do not form part of your package holiday contract with Best4Travel unless expressly confirmed in writing.

Where we facilitate the booking of an excursion as an agent only, responsibility for the provision of that excursion rests with the local Supplier.

Participation in excursions, sporting activities or adventure activities is entirely at your own risk and subject to the conditions imposed by the local operator.

39. Resort Facilities

Local facilities may change during the season.

Examples include:

  • swimming pools;
  • restaurants;
  • entertainment programmes;
  • beaches;
  • lifts;
  • spas;
  • gyms;
  • children’s clubs;
  • golf courses;
  • ski lifts.

Facilities may be temporarily unavailable due to:

  • maintenance;
  • weather;
  • refurbishment;
  • local authority requirements;
  • seasonal demand;
  • operational reasons.

Such matters are generally outside the control of Best4Travel.

40. Local Taxes, Resort Fees and Tourist Taxes

Certain destinations require travellers to pay local taxes directly.

These may include:

  • tourist taxes;
  • accommodation taxes;
  • environmental levies;
  • resort fees;
  • city taxes;
  • cruise port charges;
  • visitor levies.

Unless specifically stated as included, these charges are payable locally and may be introduced, increased or amended by local authorities without notice.

Best4Travel has no control over such charges and accepts no responsibility for changes made after booking.

41. Your Responsibilities

It is your responsibility to ensure that all members of your booking:

  • comply with these Booking Terms and Conditions;
  • comply with all Supplier terms and conditions;
  • comply with the laws of every country visited;
  • follow all health, safety and security instructions;
  • behave in a respectful manner towards fellow travellers, staff and Suppliers.

You are responsible for any costs, losses, damages or expenses arising from your failure to comply with these obligations.

42. Travel Documentation

It is your responsibility to carefully check all documentation immediately upon receipt.

This includes:

  • names;
  • dates of birth;
  • travel dates;
  • flight details;
  • accommodation details;
  • cruise details;
  • passport information;
  • ticket information.

If you discover an error you must notify us immediately.

Failure to do so may result in amendment charges or cancellation costs becoming payable.

Best4Travel cannot accept responsibility for errors that are not reported within a reasonable period after documentation has been issued.

43. Passports

Every traveller must hold a valid passport meeting the entry requirements of every country visited, including any transit countries.

Many countries now require passports to remain valid for at least six months after the date of return, although individual requirements vary.

Some countries also require a minimum number of blank pages.

It is entirely your responsibility to ensure your passport complies with the requirements of all countries on your itinerary.

Best4Travel accepts no responsibility if you are refused travel because your passport does not meet the relevant requirements.

44. Visas & Entry Requirements

Visa and entry requirements vary depending on:

  • nationality;
  • passport type;
  • destination;
  • transit points;
  • purpose of travel.

It is your responsibility to obtain:

  • visas;
  • transit visas;
  • electronic travel authorisations;
  • entry permits;
  • immigration approvals;

before departure where required.

We may provide general guidance where available, but immigration rules change frequently and it remains your responsibility to verify the latest requirements with the relevant embassy, consulate or government authority.

Failure to obtain the correct documentation will normally result in cancellation charges applying.

45. Health Requirements

You are responsible for ensuring that you comply with all health requirements applicable to your destination.

This may include:

  • vaccinations;
  • inoculations;
  • health certificates;
  • prescribed medication;
  • local health declarations.

You should consult your GP, travel clinic or other suitably qualified medical professional well in advance of departure.

Certain countries may refuse entry where mandatory health requirements are not met.

Best4Travel cannot accept liability for any loss arising from failure to meet these requirements.

46. Medical Conditions, Disabilities & Accessibility

We are committed to making travel accessible wherever reasonably possible.

To help us arrange appropriate travel, you must tell us before booking if any traveller:

  • has reduced mobility;
  • uses a wheelchair or mobility aid;
  • requires assistance at airports, ports or hotels;
  • has a significant medical condition;
  • has a disability that may affect travel;
  • requires specialist equipment or accommodation.

This allows us to confirm whether your chosen arrangements are suitable and whether Suppliers can reasonably accommodate your needs.

Failure to disclose relevant information before booking may mean that services cannot be provided or may result in Suppliers refusing carriage or accommodation.

Nothing in this clause limits your statutory rights under equality or disability legislation.

47. Pregnancy

Some airlines and cruise lines restrict travel during pregnancy.

Requirements vary between Suppliers and may include:

  • medical certificates;
  • fitness-to-travel confirmation;
  • restrictions after certain weeks of pregnancy.

If any traveller is pregnant, or becomes pregnant before departure, you should notify us immediately so that we can advise you of any known Supplier requirements.

It remains your responsibility to ensure you meet the relevant Supplier’s conditions of carriage.

48. Travel Insurance

Comprehensive travel insurance is strongly recommended for all travellers.

For many holidays, particularly cruises, long-haul travel and adventure activities, adequate travel insurance is essential.

Your policy should provide cover for, where appropriate:

  • cancellation;
  • medical expenses;
  • repatriation;
  • baggage;
  • travel delays;
  • missed departures;
  • personal liability;
  • legal expenses;
  • cruise-specific risks;
  • supplier insolvency where available.

You should ensure that your policy covers any pre-existing medical conditions and any activities you intend to undertake.

Best4Travel is not responsible for losses that would otherwise have been recoverable under an appropriate insurance policy.

49. Behaviour

All customers are expected to behave in a respectful and responsible manner throughout their holiday.

You must not:

  • behave aggressively;
  • threaten or abuse staff;
  • endanger other travellers;
  • damage property;
  • consume alcohol or drugs to the extent that your behaviour becomes unacceptable;
  • breach local laws or regulations;
  • interfere with the enjoyment or safety of others.

If your behaviour is considered by us or by a Supplier to be unacceptable, dangerous or disruptive, you may be:

  • refused travel;
  • refused boarding;
  • removed from transport;
  • removed from accommodation;
  • refused participation in excursions;
  • required to leave the holiday immediately.

In such circumstances:

  • no refund will normally be payable;
  • you will remain responsible for any additional costs;
  • you may be liable for damage caused;
  • you may be required to reimburse Best4Travel or the Supplier for any losses, fines or expenses arising from your conduct.

50. Alcohol, Drugs & Illegal Activities

The use of illegal drugs or engagement in unlawful activity is strictly prohibited.

You must comply with all local laws and regulations throughout your holiday.

Best4Travel accepts no responsibility for any consequences arising from criminal conduct, arrest, detention, deportation or refusal of entry by local authorities.

51. Special Requests

If you have a special request, such as:

  • adjoining rooms;
  • low floor;
  • high floor;
  • specific cabin location;
  • double bed;
  • dietary requirements;
  • celebration arrangements;
  • early check-in;
  • late check-out;

please let us know at the time of booking.

We will pass your request to the relevant Supplier where appropriate.

However, unless expressly confirmed in writing by us, special requests are requests only and do not form part of your booking contract.

Failure to fulfil a special request will not normally constitute a breach of contract.

52. Lost Property

Any personal belongings taken on holiday remain your responsibility.

If property is lost or left behind, we will make reasonable efforts to assist you in contacting the relevant Supplier.

Any recovery, postage, courier or administrative costs will be your responsibility.

Best4Travel accepts no liability for lost, stolen or damaged personal belongings except where required by law.

53. Complaints During Your Holiday

If you experience a problem during your holiday, you must inform the relevant Supplier (such as the hotel, cruise line, airline or tour representative) as soon as reasonably possible to allow them the opportunity to resolve the issue.

You should also contact Best4Travel using the emergency or contact details provided in your travel documentation where appropriate. Email Sales@best4travel.ie when contacting out of office hours.

Many issues can be resolved quickly if reported while you are travelling.

Failure to notify the Supplier or Best4Travel promptly may affect our ability to investigate and resolve your complaint and may reduce or eliminate any entitlement to compensation where this prejudices our ability to remedy the issue.

54. Complaints After Your Holiday

If your complaint has not been resolved during your holiday, you should submit it to us in writing as soon as reasonably practicable after your return and, where possible, within 28 days of the end of your holiday.

Please include:

  • your booking reference;
  • the names of the travellers;
  • a full description of the issue;
  • copies of any supporting documents, photographs or receipts.

We will acknowledge your complaint and investigate it fairly and promptly.

We ask that you allow us a reasonable opportunity to complete our investigation before commencing legal proceedings or initiating chargeback or other dispute procedures.

55. Customer Cooperation

You agree to cooperate with any reasonable investigation carried out by Best4Travel or our Suppliers in relation to a complaint or claim.

This may include providing:

  • written statements;
  • photographs;
  • receipts;
  • witness details;
  • copies of correspondence;
  • other relevant evidence.

Failure to provide requested information within a reasonable timeframe may affect our ability to assess your claim.

56. Our Responsibility

Where Best4Travel acts as the organiser of a Package Holiday, we are responsible for the proper performance of the travel services included within your package, in accordance with applicable Irish and European legislation.

Where we act solely as a retail travel agent, our responsibility is limited to exercising reasonable skill and care in arranging your booking with the relevant Supplier.

The Booking Confirmation will identify, where appropriate, whether Best4Travel is acting as the organiser or as an agent.

57. Responsibility of Suppliers

Many travel services are provided by independent third-party Suppliers.

These include, but are not limited to:

  • airlines;
  • cruise lines;
  • hotels;
  • tour operators;
  • transfer providers;
  • rail companies;
  • ferry operators;
  • car hire companies;
  • destination management companies;
  • excursion providers.

Each Supplier operates under its own conditions of carriage or booking and is responsible for delivering the services it provides.

Where Best4Travel acts solely as an agent, we are not responsible for the acts, omissions or insolvency of those independent Suppliers except where required by law.

58. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot lawfully be excluded or limited under Irish law.

Subject to the above, and to the fullest extent permitted by law, Best4Travel shall not be liable for losses arising from:

  • your own acts or omissions;
  • the acts or omissions of third parties unconnected with the travel services;
  • unavoidable and extraordinary circumstances;
  • compliance with legal or governmental requirements;
  • delays outside our reasonable control;
  • loss of enjoyment where no breach of contract has occurred.

Where compensation is payable, it shall be limited to the maximum amount permitted by applicable law and any relevant international conventions, including those governing carriage by air, sea or rail.

59. Loss of Personal Property

Best4Travel is not responsible for:

  • lost baggage;
  • stolen property;
  • damaged personal belongings;
  • passports;
  • travel documents;
  • jewellery;
  • cash;
  • electronic devices.

Travellers should report any loss immediately to the relevant Supplier and local authorities where appropriate.

Travel insurance should provide cover for many of these losses.

60. Duty to Mitigate Loss

If something goes wrong during your holiday, you are expected to take reasonable steps to minimise any loss or inconvenience.

Examples include:

  • informing the Supplier promptly;
  • accepting reasonable alternative arrangements where offered;
  • retaining receipts for necessary expenditure;
  • cooperating with any investigation.

Failure to take reasonable steps may affect any compensation to which you may otherwise be entitled.

61. Third-Party Websites & External Links

Our websites may contain links to third-party websites.

These links are provided for convenience only.

Best4Travel:

  • does not control those websites;
  • is not responsible for their content;
  • does not guarantee the accuracy of information published on them;
  • accepts no responsibility for products or services purchased through them.

Use of third-party websites is subject to the terms and privacy policies of those websites.

62. Website Accuracy

We make every reasonable effort to ensure that the information published on our websites, social media channels, advertisements, newsletters and marketing materials is accurate at the time of publication.

However:

  • prices may change;
  • availability changes continuously;
  • facilities may change;
  • destinations may change;
  • photographs may be illustrative;
  • maps are approximate.

Information published online should not be relied upon as forming part of your contract unless specifically confirmed in your Booking Confirmation.

63. Photographs, Videos & AI Generated Images

Photographs, videos, artist’s impressions, virtual tours and computer-generated or AI-generated images used in our brochures, websites or social media are intended to provide a general representation of the destination or product.

Actual accommodation, facilities, views, cabins, aircraft, ships or surroundings may differ.

Unless specifically stated, photographs do not form part of your booking contract.

64. Star Ratings

Hotel, ship and accommodation ratings are provided for general guidance only.

Ratings vary significantly between countries and may be based on local grading systems.

A four-star hotel in one destination may differ considerably from a four-star hotel elsewhere.

Descriptions are based on information supplied by the relevant Supplier.

65. Intellectual Property

All content on our websites, including:

  • text;
  • logos;
  • branding;
  • photographs;
  • graphics;
  • videos;
  • brochures;
  • promotional material;
  • software;
  • design elements;

is owned by or licensed to Best4Travel unless otherwise stated.

You may view and print content for personal, non-commercial use only.

No material may be copied, reproduced, republished or distributed without our prior written consent.

66. Fraudulent Activity

We reserve the right to refuse or cancel any booking where we reasonably believe that:

  • fraudulent information has been supplied;
  • false identities have been used;
  • stolen payment cards have been used;
  • payment has been dishonoured;
  • promotional offers have been abused;
  • criminal activity is suspected.

Where appropriate we may report such matters to:

  • An Garda Síochána;
  • payment providers;
  • financial institutions;
  • fraud prevention agencies;
  • relevant regulatory authorities.

67. Electronic Communications

By providing your email address, you agree that we may communicate with you electronically regarding your booking.

Important travel documents may be issued electronically.

It is your responsibility to:

  • ensure your email address remains current;
  • regularly check your inbox;
  • check spam or junk folders;
  • notify us if documentation has not been received.

Failure to read communications sent to the email address you have provided will not invalidate notices or contractual communications that have been properly sent.

68. Data Protection

We process personal information in accordance with applicable data protection legislation.

Details of how we collect, use and protect personal information are contained within our Privacy Notice, which forms part of these Terms.

69. Financial Protection

Where applicable, package holidays arranged by Best4Travel are protected in accordance with the Irish Package Travel and Linked Travel Arrangements Regulations 2018 and the requirements of our licensing and bonding arrangements.

The scope of this protection depends on the nature of the booking.

70. Alternative Dispute Resolution

If we cannot resolve your complaint directly, you may be entitled to refer certain disputes to an alternative dispute resolution body or other competent authority where applicable.

Nothing in these Terms affects your statutory rights to pursue legal remedies.

71. Governing Law & Jurisdiction

These Terms and any dispute arising from them shall be governed by the laws of Ireland.

Subject to any mandatory rights you may have under applicable consumer legislation, the Irish Courts shall have exclusive jurisdiction in relation to disputes arising from these Terms.

72. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect

73. Waiver

If Best4Travel delays or chooses not to exercise any right under these Terms, this shall not constitute a waiver of that right.

Any waiver must be made expressly in writing.

74. Entire Agreement

These Booking Terms, together with:

  • your Booking Confirmation;
  • your Invoice;
  • your Itinerary;
  • any mandatory Supplier conditions;
  • our Privacy Notice;
  • our Website Terms of Use;

constitute the entire agreement between you and Best4Travel regarding your booking.

No verbal statement or representation made by any employee, agent or third party shall form part of the contract unless confirmed by us in writing.
